GENERAL TERMS AND CONDITIONS OF SALE
By browsing this site, you acknowledge that you have read these general terms and conditions of sale, which you undertake to respect. The purpose of these conditions is to inform you of the terms and conditions for booking and cancelling, as well as responsibilities.
Article 1: Prices
Prices shown are per accommodation (room, bed, etc.) or other service, for the number of person(s) and date(s) selected above, unless otherwise specified (such as package deals).
The conversion into the customer's currency is given for information only and is not contractual. Any costs incurred in converting between the hotel's currency and the customer's currency (exchange rates, bank charges) are the responsibility of the customer.
*Unless included in the price or specifically selected at the time of booking, additional services (breakfast, half-board, full-board, etc.) are optional and must be paid for on site.
Taxes are included in the price (excluding tourist tax) or indicated in these tax details. However, you may be asked to pay certain additional taxes on arrival at the hotel, depending on the local regulations in force.
Article 2: Reservations
By logging on to www.univershotel.com, you can make a reservation directly with the hotel.
Our hotel has a real-time reservation system which is updated instantly. As soon as you have confirmed your booking, you will receive a confirmation email. Please present the booking confirmation received by email, which will be required at check-in.
The Hotel Cannes Centre Univers may modify the rates of the different rooms at any time without this modification having any consequence for the Client who will, in any case, be billed at the rate in force on the day of the reservation, unless there is a modification of the taxes in force or the introduction of new taxes.
Article 3: Terms of payment
To reserve one or more rooms, you will need to enter your credit card details.
1. In the case of a flexible reservation: No amount will be deducted at the time of booking, but we can make a pre-authorisation on the card of the total amount of your stay on the day of your booking. The amount of the stay may be paid by the customer directly on site on arrival or departure by credit card or in cash.
2. Non-cancellable - non-refundable reservation :
In the case of a non-cancellable - non-refundable reservation: the hotel will debit the total amount of your reservation upon confirmation (excluding tourist tax).
3. Methods of Payment:
Credit cards accepted for online payment: Mastercard, Visa. American Express.
On-site payment: cash, bank cards, credit cards.
For payments made with an American Express card, additional fees may apply.
This list is subject to change.
When placing your order, you must quote your credit card number and expiry date. The card must be valid on the departure date of the reservation. In the event of invalid bank details, the hotel reserves the right to cancel the reservation immediately and without notice.
Our booking system is secure and your credit card number and any personal details you give us are kept safe.
The Establishment shall also ask you to show proof of identity in order to prevent credit card fraud.
4. If the Customer has not prepaid for their stay online, the Establishment shall ask the Customer to pay a security deposit or provide a credit card authorisation (also known as a ‘pre-authorisation’) on arrival to guarantee payment of the sums corresponding to the services consumed on site.
5. Pre-authorization procedure:
The "pre-authorization" procedure consists of a guarantee for an estimated amount of the stay and grants the Establishment authorisation to charge payment based on the Customer’s actual expenses, up to the authorised amount. Only the actual amount of the invoice will be debited by the Establishment after the Customer’s departure at the end of the stay, without requiring the Customer’s physical presence or any further validation.
The amount of the request for authorisation includes the amount of the reservation (or the amount still to be paid in the event of partial prepayment at the time of reservation) and a lump sum to cover any consumption or expenses incurred by the Customer on site (breakfast if not included in the price, restaurant, bar, tourist tax if applicable, etc.). This fixed amount is determined by the establishment according to the number of people and the number of nights booked. Example: 1 night at 200 euros + 50 euros estimated for extras = request for authorisation of 250 euros.
The authorisation request is not an immediate debit, but corresponds to a reserve for future payment, authorised by the Customer's bank, which temporarily reduces the limit on the bank card used to guarantee the possibility of a future debit. In some cases, however, the authorisation request may appear as a pending debit on the bank account associated with the card used.
When the authorisation request has been activated and confirmed by the bank, at the end of the stay, the Establishment sends the Customer's bank a debit request corresponding to the amount of the invoice:
If the invoice amount is lower than the pre-authorisation request amount, the actual debit on the card will correspond to the amount actually owed by the Customer. The card limit will then be adjusted (released) by the Customer’s bank to reflect this difference (with a delay that may vary depending on the bank).
Example: Authorisation request of €300, final invoice of €260 = €260 debited and cancellation of the authorisation request for the remaining €40.
If the invoice amount exceeds the authorisation request, the entire authorised amount will be used by the establishment. The remaining balance will be debited separately from the same card. Two transactions will therefore appear on the Customer’s account: one corresponding to the authorised amount and the other to the remaining balance. It is nevertheless recommended that the Customer visit the reception desk to regularise the pre-authorised amount or to settle the full payment directly.
Example: Authorisation request for €300, final invoice for €320 = debit of €300 + additional debit of €20.
In some establishments, the currency used for the invoice may be different from that used for the authorisation request. In this case, the amount actually debited may also differ from that on the authorisation request due to possible fluctuations in exchange rates between the date of the authorisation request and that of the invoice.
In rare cases, the authorisation request may result in an early debit by the Customer’s bank. In this case, the debit will not be made twice. The balance, if in favour of the Customer, will be automatically credited back to the Customer by the bank.
If the client, upon the establishment's suggestion, chooses to prepay for their entire stay upon arrival, any additional charges within the establishment cannot be added to the room account and must be paid directly at the time of consumption.
If the reservation is canceled after the authorization request has been activated, a cancellation request for the authorization is automatically sent to the cardholder's bank. In rare cases, this cancellation may appear as a refund.
It is worth noting that the release of the pre-authorized amount (or refund) typically takes between twenty-four (24) and forty-eight (48) hours, but the processing time may extend to seven (7) business days or more, depending on the cardholder's bank.
Article 4: Reservation Guarantee - Check-in and Check-out
The Hôtel Cannes Centre Univers is open 24 hours a day, 7 days a week.
Reservations officially take effect from 2 p.m. on the day of arrival and end at 11.30 a.m. on the day of departure.
Early check-in - subject to availability. Late check-out - between 11.30 a.m. and 3.00 p.m. - €50 surcharge.
Article 5: Pets
Pets are accepted at an additional cost of €20.
Article 6: Cancellation or modification a reservation
In the case of Accommodation Services (reservation of rooms within an Establishment or other types of accommodation), the Customer is reminded that he/she does not have the right of withdrawal provided for in article L. 221-18 of the Consumer Code, in accordance with article L. 221-28 paragraph 12 of the Consumer Code, which excludes this right for contracts relating to the provision of accommodation services which must be provided on a specific date or for a specific period.
For each Service reservation, the Special Terms and Conditions specify the terms and conditions for cancelling and/or modifying the reservation.
Reservations with a prepayment cannot be modified and/or cancelled. Deposits (sums paid in advance) will not be reimbursed. In this case, this is mentioned in the Special Conditions.
Article 7: Insurance and Liability
A safe is provided in each room. The hotel disclaims any responsibility in case of theft, loss, or damage to the clients' belongings during their stay.
The client must inform the establishment of any damage they may have caused. They are responsible for all damages caused by their actions and agree, in the event of damage to the premises, to bear the costs of restoration.
The hotel reserves the right to charge the credit card provided at the time of booking for any extras or services not declared and not billed at check-out.
The Client, in particular, agrees that by making a final reservation for a Service, they will pay the price and adhere to the Specific Terms related to it. Specifically: Any reservation or payment that is irregular, ineffective, incomplete, or fraudulent due to a fault on the Client's part will result in the cancellation of the Service reservation at the Client's expense, without prejudice to any legal action the Hôtel Cannes Centre Univers may take against the Client.
Any behavior contrary to good morals or public order within the establishment, as well as failure to comply with the establishment's internal regulations, may lead the manager or any other service provider to request the Client to leave the premises without any compensation and/or without any refund if payment has already been made. If no payment has been made, the Client must settle the cost of services consumed before leaving the premises.
The Client also agrees not to use the establishment's IT resources (including the Wi-Fi network) in any way for the reproduction, representation, distribution, or communication to the public of works or objects protected by copyright or related rights, such as texts, images, photographs, musical works, audiovisual works, software, and video games, without the authorization of the rights holders as provided in Books I and II of the Intellectual Property Code, when such authorization is required. The Client is also required to comply with the security policy of the establishment's internet service provider, including the rules of use for security measures implemented to prevent the illicit use of IT resources and to refrain from any actions that would compromise the effectiveness of these measures.
Article 8: Force majeure
Neither party shall be held liable to the other party for the non-performance of its obligations resulting from a force majeure event. It is expressly agreed that force majeure suspends the execution of the parties' reciprocal obligations, and each party bears the costs arising from it. Events generally recognized as force majeure by the jurisprudence of the Court of Cassation (strikes, terrorist attacks, death, etc.) are considered as such. If the force majeure event lasts more than thirty (30) days from its occurrence, these General Terms and Conditions may be terminated by either party without either party being entitled to claim damages.
In the event of force majeure or another exceptional event that prevents the Service from being carried out and in particular prevents the reserved room in the Establishment from being made available to the Customer, the Establishment may reserve the right to accommodate the Customer, in whole or in part, in an Establishment of equivalent category or to carry out a Service of the same nature, subject to the prior agreement of the Customer.
In the event of relocation, the choice of establishment will be made by the hotel itself. The cost of relocation (additional room rate) will be paid by the hotel except in cases of force majeure as detailed above.
Article 9: Commitment
The entry of the required bank details and the acceptance of these General Terms and Conditions and the Special Terms and Conditions by electronic means constitute an electronic contract between the parties, which is proof between the parties of the reservation of the Service and of the sums due in respect of the said reservation.
The General Terms and Conditions and the applicable Special Terms and Conditions express the entirety of the obligations of the parties. No other condition communicated by the Customer may be incorporated into them.
In the event of a contradiction between the Special Terms and Conditions and the General Terms and Conditions, the Special Terms and Conditions shall be the only terms applicable to the obligation in question. In the event of a contradiction between, on the one hand, a partner's general terms and conditions of any kind whatsoever and, on the other hand, these General Terms and Conditions, the provisions of these General Terms and Conditions shall be the only ones applicable to the obligation in question.
If one or more of the stipulations of the General Terms and Conditions are held to be invalid or declared as such in application of a law, regulation or following a final decision of a competent court, the other stipulations will retain all their force and scope.
The governing language of these Terms and Conditions is French. If the General Terms and Conditions are translated into a foreign language, the French language shall prevail over any other translation in the event of any dispute, litigation, difficulty in interpreting or executing these terms and conditions and, more generally, concerning existing relations between the parties.
Article 10: Personal data
When the Client uses the Website, particularly when making a reservation, Hôtel Cannes Centre Univers processes personal data in accordance with the terms described in the "Privacy Policy".
The Customer is informed, on each of the personal data collection forms, of the compulsory or optional nature of the answers and information by the presence of an asterisk.
If the Customer fails to provide information identified as mandatory, Hôtel Cannes Centre Univers may not be able to register a reservation, manage the Customer's participation in the loyalty programme or handle the Customer's complaints.
Thus, the information collected as part of the Client’s reservation is intended for Hôtel Cannes Centre Univers, its entities, its partners, its service providers (including online payment providers), and the establishments for the purposes of executing the reservation or taking pre-contractual measures. Provided that the safeguards required by applicable regulations have been properly implemented, the Client’s data may be transferred from Europe to countries that, from the European Union’s perspective, do not provide an equivalent level of data protection.
The Client may exercise their rights under personal data protection regulations at any time. All relevant information for this purpose is provided in the "Privacy Policy".
